A work accident has left an 18-year-old, who was inexperienced at using a forklift truck, with serious injury after it overturned.
Nuneaton magistrates were told the personal injuries suffered by the victim included a fractured leg, shattered elbow and a dislocated ankle. He was in hospital for nearly a month, has had at least five operations on his left arm and is no longer able to straighten this arm fully.
The young employee was trying to unload a delivery using a forklift when the vehicle fell on him leaving him trapped against the ground.
A Health and Safety Executive (HSE) investigation found that the victim had only been working for the company for three weeks before the accident took place and it was his first job since leaving education. He had not been given any formal training in operating a forklift.
The employer, a recycling company, was fined £4,000 for breaches of health and safety regulations which led to the work accident, with costs of £2,832.
Now that liability for the work-related accident has been established, the victim may wish to make a compensation claim through a no win no fee solicitor for suffering and loss of earnings.
