A widow whose husband was pulled through a shredding machine at a recycling plant has made a no win, no fee claim for £400,000.
The 36-year-old man was working with his 15-year-old son at a recycling plant in Kettering when the work accident occurred.
According to reports, the paper shredder became jammed and so both father and son climbed inside to unblock the obstruction when it suddenly began working again.
The teenager was pulled to safety by a colleague but his father was dragged through the machine.
The family's personal injury solicitor said that the recycling company admitted primary liability in November 2005 for the accident at work but disputed the amount of compensation that should be awarded after arguing that the man was careless.
The widow has already received £229,000 through the company's death-in-service trust fund and insurance but her personal injury solicitor has stated that this money should not affect the no win, no fee claim, which has been made for loss of dependency.
The compensation solicitor said, "Those monies were paid as the widow of the deceased.
"What is clear is that the company did not pay monies as part of this compensation claim."
"The no win, no fee continues."
