A driving examiner who suffered whiplash during the "worst driving test incident of his career" has been awarded the go ahead to receive car accident compensation.
The 35-year-old sustained the whiplash injury when the test candidate braked suddenly, forcing another motorist to make an emergency manoeuvre.
The judge, hearing the case at the Court of Session in Edinburgh, said that she considered the examiner's evidence to be "reliable and accurate". She also said that she considered the defendant's "standard of driving fell below the required standard of care for a driver.
"In my opinion, her driving was plainly careless. She seemed unable to drive with due care and attention.
"I think... her driving, as described by the pursuer, would be memorable."
The car accident claimant confirmed to the court that the incident was the worst he had experienced so far in his twelve-year career. The test candidate is understood to have failed her examine, with 14 faults recorded.
Another hearing is to be scheduled, during which the claimant will learn if he is to receive the full £15,000 compensation his whiplash claim is demanding.
