A teacher from Peterborough in Cambridgeshire has been awarded £16,500 in work accident compensation after falling over a chair and suffering a serious personal injury.
The 67-year-old teacher had been trying to get the attention of another colleague at the secure school for troubled girls when the incident took place.
The teacher tripped over as she squeezed past a chair and suitcase in order to raise the alarm that her teaching assistant had been delayed and she had been left alone in the classroom, which was against the rules.
The work accident caused the teacher to break her hip in the fall.
She was awarded £16,500 in compensation at Lincoln County Court, however Peterborough City Council appealed against the decision after lawyers claimed that the circumstances were unforeseeable and the authority were not at fault.
The challenge was denied by the Court of Appeal who stated that it was a 'breach of duty' by the council that resulted in the accident.
The council has now paid out the £16,500 in work accident compensation as well as the cost of legal fees.
