Ten years after a car accident in Northern Ireland, personal injury solicitors for the father of a boy who died in the incident have secured him further compensation due to his ongoing psychiatric illness.
The man, now 42, was originally awarded £272,000 for personal injuries, loss and damage after the car in which he was travelling was hit from behind. The claimant's two-year-old son died as a result of his injuries, and the man's wife and three other children were all badly hurt.
The other driver was found liable for the car accident and compensation was paid, however, the effects of the accident led to the claimant developing post-traumatic stress disorder, depression and pathological grief.
The original compensation award included £57,000 for future loss and £65,000 for general damages, but the car accident victim's personal injury solicitors felt the amounts were too low.
The High Court Judges hearing the appeal said the awards for moderately severe psychiatric damage were not wholly erroneous as they were close to the highest possible awards, but the evaluation of future losses were wrong.
The personal injury claimant was eventually awarded an extra £33,000 for future financial losses.
