A personal injury solicitor representing a woman who suffered serious injury when she was attacked by cows in Cumbria in 2003 has succeeded in achieving his client a favourable ruling in her claim for accident compensation.
The claimant's personal injury solicitor argued that the farmer responsible for the cows should be considered liable on the grounds that he should have foreseen the risk.
However, the defendant's solicitor is to appeal this decision and has the support of the Royal Association of Dairy Farmers. A spokesperson from the association comments, "The number of footpaths we've got across this country - and more and more access is being made available to walkers - it's one of those situations that's going to occur from time to time.
"I mean there are some parts of the country now where farmers can no longer put cattle in fields because the footpaths are used so much.
"If you think around some of the larger towns where footpaths are on the edge of towns, some of those fields they've already had to take cattle out of."
If the appeal is turned down, it is expected that the claimant's personal injury solicitor will secure his client £1 million in damages.
