The personal injury lawyers of a recreational bagpipe player from Perthshire have won their client £3,750 in accident compensation for injuries suffered to his left arm after a faulty gate smashed into him during high winds.
A Perth Sheriff's court ordered a housing association to pay out the compensation after the claimant's personal injury lawyers successfully argued that they should be considered liable. It is understood that one factor behind this decision was the housing association's failure to have repaired the gate even though they had received complaints about its function a full six months before the accident.
Unfortunately for the bagpipe player, his injuries mean that he can no longer play his instrument without discomfort, with the sheriff saying, "His arm feels stiff and slightly weaker as a result of applying pressure to the bag and supporting the weight of the bagpipes."
Two weeks after the accident the bagpipe enthusiast was told that he had broken his arm and has since had surgery to insert several screws and metal plates into the affected area. This was clearly a factor in the sheriff's decision. He commented, "The fracture was fixed with the insertion of a plate and screws. He has an 8.5cm scar."
"He continues to suffer slight discomfort when weight is put on his arm, such as when he is rising from a chair."
