UNITED STATES – Contamination issues with the anti-coagulant drug Heparin have led to personal injury compensation action being taken against the manufacturer of the drug. According to personal injury lawyers representing the claimant, damages are being sought for physical and emotional pain, medical expenses, and punitive damages (a form of damages not provided for in personal injury compensation claims in the UK).
The product liability issue is believed to have arisen as a result of contamination with the chemically altered form of the drug chondroitin sulphate at the relevant pharmaceutical company's Chinese manufacturing facilities.
A spokeswoman from the claimant's personal injury lawyer firm, Lieff Cabraser Heimann & Bernstein, LLP, commented, "Prescription drug manufacturers have a duty to produce products that are safe and free of dangerous ingredients. Only through a lawsuit or otherwise making a claim can patients obtain compensation for their injuries. The American public needs the drug companies to take responsibility for the safety of their products -- especially those like Heparin, which are manufactured in part in China."
She added that the personal injury compensation claim would seek to find the company liable on the grounds that they had "inadequately inspected its product", and that such testing would have shown that the drug "posed a life-threatening risk to patients".
