A man who suffered horrific work injuries after being crushed by half a tonne of steel may be entitled to make a personal injury claim for compensation after his employer was found guilty of health and safety failings.
The work accident, at a pipe coupling manufacturer in Hitchin, left the 39-year-old machine operative with internal bleeding as well as multiple fractures.
As a result the injured man was treated in hospital for six weeks, followed by a further six weeks at home. Although he has resumed work since the workplace accident in May 2009, he has et to make a full recovery.
Stevenage Magistrates' Court was told that the employee had been connecting pipes and was moving a large set of rings weighing 250kg each when they fell on him.
The company the man worked for was found to have an inadequate health and safety system meaning that the metal rack on which the rings were resting was unsuitable and the company should have assessed the risk of them falling.
The factory owner was fined a total of £25,000 for breaching Health and Safety Regulations plus £3,387.25 court costs.
Now liability for the accident in the workplace has been decided, the victim may now wish to make a personal injury claim against his employers for compensation for his suffering.
