A mother-of-four from Leamington Spa has received no win, no fee compensation for an accident in which she was hit by a toboggan. She has said that she believes the incident would never have happened had the area been adequately supervised.
The claimant, who was recently widowed following the cancer-related death of her husband, suffered numerous injuries in the accident, including fractured vertebra.
A no win, no fee compensation settlement of £8,500 was agreed following an admission of liability from the leisure company responsible for operating the piste in Tamworth - it had previously denied liability but made the admission after being confronted with court proceedings.
The claimant's personal injury solicitor said that the claim "was legitimate and fair and should have been settled straight away, without the need for court proceedings."
She added, "It is not right that she was forced to endure a three-year battle, which unfortunately coincided with her husband passing away.
The claimant, a fitness instructor, said that she took strength to continue with her no win, no fee compensation battle after reading the Winston Churchill quote "Never Give In" etched into her late husband's memorial bench.
