The mother of a Scottish girl who suffered a whiplash type injury while playing a game of non-contact rugby has launched a no win, no fee claim against Edinburgh City Council.
It is understood that the whiplash style neck injury, which occurred as a resulted of the girl being hit by a rugby ball, has resulted in her needing to wear a neck brace, with her mother voicing concerns that the injury could lead to lasting damage.
A spokesperson for the charity that organised the rugby match in which the girl suffered injury expressed disappointment at news of the no win, no fee claim. "This was just an accident," he said. "I don't know why it has come to this when we are only trying to do something good."
A council spokesperson acknowledged it had received a letter from a personal injury solicitor detailing the legal action. "We are aware of an incident that took place at the school in October last year," she said.Adding, "All the appropriate procedures are being followed but with formal proceedings under way, it would not be appropriate to comment."
Although not commenting directly on the no win, no fee claim, a spokesperson with Scottish Rugby sought to emphasise the organization's good safety record, saying, "We have got many thousands of young people across Scotland participating in rugby and the quality of training we have for our coaches and volunteers emphasizes the importance of player safety and welfare."We have got a positive track record in ensuring the safety of our young people and all players."
