A medical negligence claim writ has been issued by solicitors representing a mother whose daughter suffered severe brain damage during her birth at a Gloucestershire hospital.
The girl, now 6, has cerebral palsy affecting the basic function of all her limbs and is unlikely to ever be able to walk.
According to the XX1XX writ, if hospital staff had taken the correct action to monitor the girl's heart rate and temperature during the birth, she would have been delivered earlier and not suffered any problems.
The personal injury solicitor representing the girl and her mother commented that there were, "clear indications that she should have been delivered at an earlier stage, by assisted vaginal delivery or caesarean section, and that if she had been delivered earlier, she would have avoided brain injury."
A spokesperson from the relevant NHS Foundation Trust refused to comment on the medical negligence, saying it would be inappropriate to comment on an ongoing case.
