A Canadian woman has made personal injury legal history there after being awarded a specific provision of accident compensation for inability to do housework. The decision was issued by the Ontario Court of Appeal and upholds an earlier ruling.
The claimant's personal injury solicitor explained the significance of the accident compensation decision. "It's the first time the Court of Appeal has acknowledged that the loss of the ability to perform housekeeping is worthy of compensation," he said.
He added, "I think it's significant. The judge that wrote the decision, I think, saw this as a feminist issue. Although anyone could lose housekeeping capacity as a result of injuries, in our society traditionally women have fulfilled that role. Our courts have traditionally recognized that if somebody loses the ability to work, that's worthy of compensation. Now people who work in the home are entitled to the same consideration."
Canadian press report that the claimant suffered passenger injuries in a 2000 car crash. She now suffers from the chronic pain condition fibromyalgia as well as depression and anxiety.
The woman, who was described as being a "clean freak" before the injury, was awarded $60,000 (CAN) accident compensation for "loss of housekeeping capacity".
