A South Yorkshire-based electrical worker who suffered amputation of his left leg following a 13 foot ladder accident fall has secured a work accident compensation payout of nearly half-a-million pounds.
The ladder accident claimant, who lives just outside of Sheffield, had been engaged in some cable work on the exterior of a house in Rotherham when the incident occurred. And, although he landed on his feet following the fall, both his ankles were so badly shattered that one needed an external fixator and the other needed amputation.
The claimant's no win, no fee solicitor successfully argued that a safety harness would have avoided the accident; the man's employer was found liable for this breach.
The solicitor commented, "[The claimant] should have been given scaffolding or a harness to make sure he was safe, and should not have been asked to carry out a dangerous task he had not been given training for.
"Falls from heights remain the most common cause of serious injury in the workplace."
While the claimant himself added, "The simple fact is that the accident should never have happened, and it would never have happened if my employer had given me the correct training and safety equipment for the job in hand."
And, he said, the ladder accident could have been much worse "if I'd landed differently or banged my head".
Injury compensation totalling £450,000 was awarded the man.
