A woman who suffered a head injury when a metal flower container fell on top of her while she was drinking outside a public house in London may seek to make a claim for compensation when she has recovered.
Witnesses said the 49-year-old victim had been sitting outside the Sussex Arms in Paddington when, without warning, the heavy tub, full of earth and plants, fell from the first floor where it had been positioned with others on a ledge above the street.
Westminster council health and safety officials have begun an investigation into how the planter, which was one of several placed along the frontage of the pub could have fallen.
A council spokesman said, "Any plant pots which are not fixed to the building do not need planning permission and it is the duty of the owner to make sure that they are safely in place and there is no danger of them falling onto people below."
The woman was from Manchester and working in London as a painter and decorator. She had an operation for her head injury at St Mary's Hospital and her family, who were at her bedside, may consider consulting a no win, no fee solicitor about legal action against the pub landlord or owner.
