A grandmother from Southampton has launched a personal injury compensation claim after suffering a serious leg injury in Santa's grotto.
The 73-year-old from Hedge End was visiting Santa's grotto at a prestigious Oxford Street store in London with her two grandchildren when the accident happened.
As the woman and her two granddaughters entered the grotto to have their photograph taken with Santa, the woman tripped over a stray Christmas bauble and fell to the floor.
The fall caused the woman to fracture her thigh and she was rushed to hospital where she underwent major surgery to insert a metal plate and screws.
The grandmother has since launched a personal injury compensation claim against the event management company, who ran the grotto.
Following a hearing at Southampton County Court the woman's claim was rejected after evidence highlighted that the bauble had not been clearly visible, so staff at the grotto could not have been expected to remove it.
However, the woman appealed against this decision and judges at the Civil Appeal Court in London agreed that the fall was caused by the negligence of grotto staff.
The woman could receive up to £30,000 for her personal injury compensation claim.
