Faulty product injury compensation of £6,000 has been awarded to a Scottish boy who broke his leg after an accident involving a Thomas the Tank Engine ball pool.
The outcome of the faulty product injury compensation claim centred on a fault with the ball pool that resulted in it suddenly deflating on the toddler's left leg. The boy suffered a severe spiral fracture as a result of the malfunction.
The boy's mother commented on the incident, "It deflated on top of him, trapping him inside and catching his leg. It was terrifying - he was screaming in pain."
While the boy's father spoke of the retailer's reaction to their initial complaint, "There was no apology. They took the pool and sent us reports showing there was a manufacturer's defect. There has been no mention of a recall."
The Scottish personal injury solicitor who represented the faulty product injury compensation claim commented that the retailer in question "have a duty to ensure that if they sell a product, it is manufactured properly. They cannot hide behind the mistakes of others."
