A cyclist who suffered a neck injury when he was catapulted off his bicycle while cycling near Leeds is making a no win, no fee claim for injury compensation.
The 51-year-old was travelling over an automatic barrier owned by Yorkshire Water when it unexpectedly rose, causing him to be thrown off his bike.
Since then he has had to undergo extensive treatment, as well as surgery to a broken shoulder he sustained in the accident.
The solicitor representing the man's no win, no fee claim alleges that the water firm breached section two of the Occupier's Liability Act.
"The floor barrier which caused my injuries had no audio or visual warning for cyclists or walkers at all - it merely had a sign for cars, but nothing that stated the possible danger for those crossing it," said the no win, no fee claim actionee.
"The barrier had only been down for a matter of seconds and I cycled across immediately. The next thing I remember was waking to hear my daughter screaming and a member of our cycling club calling for an ambulance."
