A young footballer, whose hospital treatment was delayed, causing him to suffer a brain injury, has been awarded £1.7m clinical negligence for the lack of care which led to him having a grand mal seizure.
The High Court in London was told the Lincoln boy's problems started when he clashed heads with another pupil at an after-school football club when he was seven. His mother called the NHS out-of-hours service because he had a headache and vomiting but was not advised that he should see a doctor.
Emergency surgery was needed at Lincoln County Hospital to save his life the next day after he suffered an extradural haematoma and ruptured meningeal artery. His ongoing brain injury means that he is now confined to a wheelchair and has difficulty with communication.
Lawyers for the boy, who sued West Lincolnshire Primary Care Trust through his mother for the 2004 personal injury accident, said that if he had been examined earlier his injuries could have been avoided.
In May, 2009, the PCT had agreed 75% liability for the boy's brain injury caused through its clinical negligence. The compensation claim settlement package was approved 17 months later.
