A clinical negligence claim alleging that a 74-year-old man underwent unnecessary surgery and later contracted MRSA has been settled with compensation of £60,000 agreed.
In April 2007, the Essex man was told he needed extensive surgery to resolve his chronic bowel condition. Subsequently, his rectum and bowel were removed.
While recovering from the operation in Basildon Hospital, the man became infected with the superbug MRSA.
On his behalf, a specialist medical negligence solicitor said that his underlying condition could have been treated with drugs rather than the drastic option of surgery. Although it was accepted the later infection probably was inevitable, staff could have managed the problem better.
The Basildon and Thurrock University Hospitals NHS Trust originally denied the patient's medical negligence claims of mistreatment but has agreed to pay him £59,000 relating to the operation and £1,000 for problems with treatment of the infection.
