A 26-year-old man who suffered a paralysing spinal injury as a passenger in a fatal car crash has received a seven-figure sum of injury compensation.
The claimant was a passenger in a friend's car in 2003 when, driving through Cornwall, the friend lost control of the vehicle, careering into oncoming traffic. The driver received fatal injuries, while the claimant sustained a life-changing spinal injury.
Both the claimant and accident reconstruction experts believe the driver was travelling at around 70mph at the time of the car crash. No win, no fee solicitors representing the claimant were due to argue that this was too high a speed and constituted negligence; however, they have now reached agreement with the relevant insurance company, meaning the case will not have to be disputed any further in court.
The claimant issued a court statement in which he remembered, "The rear off-side of the car just spun around. Everyone in the car went quiet. I can remember the rear of the car swung around and we just ended up travelling sideways on the wrong side of the road. I remember [the driver] trying to correct it and we ended up swinging around the other way."
A High Court hearing due to take place later this year will determine whether, in addition to his £2.25 million car crash compensation settlement, the claimant will also receive index-linked payments for the remainder of his life.
