Despite all the damage that the recent pothole problem has caused, only one in nine drivers who made claims for motorway potholes were successful.
According to the BBC, of 382 claims for compensation for damage caused by motorways in England and Wales, just 40 of them were paid out.
Top of the compensation claim for potholes list was the M1 with 49 accident claims made. However only five motorists out of those who claimed actually received payment for the damage the potholes inflicted.
For a claim to be successful, the motorist has to provide evidence that their car was damaged by a pothole. If the Highways Agency or council has already monitored the condition of the road and repaired holes, they are not liable to pay out.
Administrator of the potholes.co.uk website, Duncan McClure Fisher said motorists are contacting the site frustrated because they are unable to get money from the Highways Agency and local authorities to pay for car crash repairs.
However councils say that they paid out £30m in car accident compensation and hundreds of thousands of potholes have been filled in.
