A 25-year-old man, who suffered very severe brain injury in a road traffic accident in 2006, has now been granted the possibility of receiving personal injury compensation.
The victim was crossing the High Street in Sheerness, in Kent, when a 26-year-old driver taking his friends to a takeaway in his father's new BMW, was in collision with the pedestrian.
The 25-year-old was thrown across the road and his head struck one of the many bollards at the side of the pavement, which were in place as a traffic calming measure.
The judge ruled that the driver was 75% responsible for the accident, stating that although he had clearly been driving too fast in the busy area, the victim was also partly to blame for his injuries, having not looked to see if the road was safe to cross before stepping off the pavement.
The brain damage caused to the pedestrian through his head trauma, now means that he needs 24-hour care. His mother started legal action for his life-changing accident, and now her son is likely to receive millions of pounds in compensation, which will go towards his long-term care.
Found 75% liable for the brain injury to the victim, the driver's insurance company will have to pay compensation on that basis. The settlement will probably be substantial, despite the 25% liability deduction made by the judge.
