Writ argues asphyxiation caused cerebral palsy

Birth injury lawyers acting for a Kettering teenager have served a medical negligence claim writ to the High Court.

In the writ, the birth injury lawyers argue that delayed delivery of the boy was to blame for him developing cerebral palsy. The writ adds that the health authorities were negligent in not having appropriate obstetric or medical protocols for induction, with the 1984 midwifery protocol being outdated and insufficient.

The 15-year-old's legal team argue that these factors, together with inadequate checking of heartbeat during delivery, led to the boy's asphyxiation and eventual cerebral palsy.

The relevant health authority did not wish to make any statements regarding the clinical negligence claim, saying only, "The action is in progress so we cannot comment at this stage of proceedings."

The boy's birth injury lawyers are hoping to secure him £300,000 in compensation.
