Those detractors of the so-called "compensation culture" who believe we are a nation of tricksters who will try anything to make a quick compensation claim, should be somewhat appeased after a recent court judgement did not go quite the way the claimants had hoped.
A couple who took an "Amazon adventure" holiday with a well known cruise company and who later made a £3,000 claim for compensation after various incidents on board the ship, were told by the judge at Lewes County Court they would receive just £150.
The judge commented, "If you go to another country things are different, that's part of the holiday. You can be having a nice time then suddenly something happens and there's an accident.
"It's an accident and the danger is that accidents don't necessarily give rise to a claim even though the effects of it can be thoroughly miserable and catastrophic.
"Part of the adventure is that you are in another environment. If you don't like it, you don't go anywhere like that at all or you don't eat the food. We tend to blame someone but we must not do that, it's the adventure."
The couple was awarded £120 costs when the judge decided that the tour operator should have offered better care to one of the holidaymakers after she fell off a plastic chair, smashed her glasses and allegedly suffered concussion.
A cruise spokesperson said of the compensation claim award, "We are pleased with the outcome of this case. The safety, security and welfare of our passengers is and always has been our absolute priority and we make every effort to ensure they have an enjoyable holiday."
