A carpenter may be entitled to make an accident at work claim after suffering a serious personal injury when he fell three metres off scaffolding whilst on the job.
The 60-year-old worker from Verwood, Dorset, had been contracted to construct the roof of an extension at a town property. The extension was to be built above an already existing garage which protruded beyond the face of the main building. This meant that there was a step in the scaffold at roof level.
The incident occurred when the employee was descending a ladder when he accidentally took an extra step backwards over the edge of the platform. This caused him to fall to the ground, and resulted in him fracturing his spine and damaging his ankles.
An investigation by the Health and Safety Executive (HSE) found that the platform where he had been working had no guard rails. The ladder used to access the working platform was positioned outwards which meant that anyone using the ladder was forced to stand backward at the unguarded edge.
The company was fined £4,000 for breaching the Work at Height Regulations, and may possibly have an accident at work claim to pay to the victim if he decides to pursue a civil claim for compensation.
