Military compensation – how to claim?

Working in the Armed Forces is a high risk occupation. Activities such as combat, assault course training and riot training clearly involve a greater than normal risk of injury. Due to the nature of this work, injuries that take place are often very serious such as head injuries, spinal cord injuries, amputations and burn injuries, and each year thousands of MOD staff claim military compensation.

Duty of care
All employers must carry out risk assessments to ensure staff are protected from hazards and accidents are prevented. The MOD is no exception and whilst the type of work involves a higher level of risk than most other jobs, it has to conform to some strict regulations.

When there are accidents, whether minor or serious, a risk assessment must be carried out to prevent the same accident taking place again.

The 3-year rule
All work accident claims must be made within three years of the incident taking place. However, if the extent of the injuries mean that the claimant is unable to make a claim, this rule may not apply.
