We have developed our service to make the process of claiming personal injury compensation as straight forward as possible.
This is what you can expect when you contact JMW personal injury solicitors:
1. Your initial call or email will be received by a member of our claims team. They will be able to answer any questions you have about our service and assess the circumstances of your injury and advise the likelihood of having a successful claim for personal injury compensation. To help us to do this, you will be asked to provide information regarding the accident, your injury and who you believe is responsible.
2. If your injury is of a severe or sensitive nature we are happy for one of our experienced personal injury staff to visit you at home or hospital to discuss your injury and answer any questions.
3. Should we feel you have a valid case and you would like us to help you to pursue a personal injury claim, a member of our personal injury team will be appointed to start to put together evidence to support your claim. They are responsible for obtaining all the information we need to put your claim together as quickly as possible. This may include witness statements, medical reports, police reports and engineer's reports, which will be used as evidence to support your claim. We will also send a 'Letter of Claim' to the other person (or their insurance company) giving notice that you intend to pursue a claim against them for damages caused by their negligence. We will ask you to keep a personal injury diary as a record of your recovery to show how your injury or illness has affected your everyday life. We will then keep you informed every four weeks on how your claim is progressing.
4. Treatment and rehabilitation is central to JMW personal injury policy. Over the years we have helped a number of clients effectively rebuild lives that have been shattered by a devastating injury, with the help of rehabilitation services. Depending upon your injury, this could include some of the following: medical attention, pain relief, physical therapies (e.g. physiotherapy), surgery, retraining and counselling. 5. Once all the information required to support your claim has been gathered, your claim will be passed to a different member of our personal injury team. They are responsible for securing the best possible amount of compensation for you. They will put together a 'Schedule of Loss and Damages', which details all the financial losses (heads of claim) that are being claimed for.
This will be sent to the other side, prior to entering into negotiations to settle the claim..
6. Our priority is to ensure the best possible compensation for our clients and early settlements aren't necessarily advisable. Whilst the majority of our cases are settled out of court, in some cases it may be necessary to issue Court proceedings. If agreement can't be reached it may be necessary to pursue your claim to trial. This may happen in cases where there is a dispute on liability or a likely high compensation award.
